Privacy Policy

Intent/Purpose

To provide a clear statement wiith respect to the collection, use and disclosure of personal information on and collected from the Massage Therapy Association of Manitoba (MTAM) Web site.

Definitions

Personal Information:

Information about an identifiable individual, that does not include the name, position title, business address or telephone number of an employee of an organization. (Part 1, Section 2 of the Personal Information Protection and Electronic Documents Act.)

Policy

General

The MTAM is committed to protecting the privacy rights of all individuals who visit its Web site.  The association is committed to all major tenets of privacy protection and as such the MTAM will:

  • Only collect personal information that is necessary to the fulfillment of services or the delivery of services to our visitors and with the consent of the individual
  • Protect all personal information collected by the MTAM and take all reasonable and proper measures to prevent its inadvertent disclosure
  • Not disclose information collected or maintained by the MTAM without the prior written consent of the individual to whom the information pertains
  • Allow any individual to view any personal information collected and/or maintained about them by the MTAM provided the disclosure of that information does not violate the right to privacy of another individual.
Non-personal information

The MTAM Website may automatically record some general information about your visit, such as:

  • The Internet domain for your Internet Service Provider (ISP)
  • The Internet Protocol Address (IP Address) of the computer accessing the Web site
  • The type of browser (such as Internet Explorer, Mozilla Firefox, Google Chrome) you are using
  • The type of operating system you are using (Windows, Unix, Linux, Macintosh)
  • The date and time you visit the site and the pages that you visit, along with the address of the previous Web site you were visiting if you came to our site through a link from another site.

The MTAM uses this information for statistical analysis, to allow improvements to the site to make it more user friendly.  The MTAM may disclose aggregate data based on this information to our sponsors, clients or advertisers for promotional and/or auditing purposes.  This tracking system does not record personal information about the user.

Cookies

The MTAM website uses cookies, if enabled in your web browser. Cookies allow the website to remember your browser as a previous visitor, and any preferences you may have selected. Cookies allow the MTAM to customize the website content based on collected usage information, no personal information is stored as outlined above.

Links and Privacy

The MTAM’s privacy statement applies only to the MTAM Web site.  When you leave this site, the policies of the site you are visiting apply and the MTAM assumes no responsibility for the content and/or operations of sites that are linked from this site.  Users are encouraged to review the privacy policy of all sites they visit.

MTAM provides its service to you, subject to the following Terms of Use (‘TOU’), which may be updated by us from time to time without notice to you. In addition, when using particular MTAM services, you and MTAM shall be subject to any posted guidelines or rules applicable to such services that may be posted from time to time. Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to the TOU.

You understand and agree that the Service is provided ‘AS-IS’ and that MTAM assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser.

MTAM, the MTAM logo, and other MTAM logos and product and service names are trademarks of MTAM (the ‘MTAM Marks’). Without MTAM ‘s prior permission, you agree not to display or use in any manner, the MTAM Marks.

MTAM does not represent or endorse the accuracy or reliability of any of the information, content or advertisements (collectively, the ‘Materials’) contained on, distributed through, or linked, downloaded or accessed from any of the Services, nor the quality of any products, information or other materials displayed, purchased, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the Service (the ‘Products’).

You hereby acknowledge that any reliance upon any Materials shall be at your sole risk. MTAM reserves the right, in its sole discretion and without any obligation, to make improvements to, or correct any error or omissions in any portion of the Service or the Materials.

MTAM encourages you to exercise discretion while browsing the Internet using the Service. The Service may direct you to sites containing information that some people may find offensive or inappropriate. MTAM makes no representations concerning any endeavor to review the content of sites listed in the directory or any of the Materials, and so MTAM isn’t responsible for the accuracy, copyright compliance, legality or decency of material contained in sites listed in the directory or in the Materials. The TOU constitute the entire agreement between you and MTAM and govern your use of the Service, superseding any prior agreements between you and MTAM

The TOU and the relationship between you and MTAM shall be governed by the laws of the Province of Manitoba without regard to its conflict of law provisions. If any provision of the TOU is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOU remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOU must be filed within one 1 month after such claim or cause of action arose or be forever barred.
